Article 1 General terms and conditions and definitions
These general terms and conditions apply to a temporary accommodation agreement between Local Residence by Hotel Keyser and the customer of an apartment or studio. These general terms and conditions also apply to the quote that Local Residence by Hotel Keyser submits to the customer and to all bookings made by the customer.

The Customer: The person who uses the apartment or holiday apartment during a particular period and who owes the agreed price per night to Local Residence by Hotel Keyser and/or requests a quote from Local Residence by Hotel Keyser or makes a booking for an apartment offered by Local Residence by Hotel Keyser.
Local Residence by Hotel Keyser only accepts bookings made by persons that are at least 18 years old.
Local Residence by Hotel Keyser: Local Residence by Hotel Keyser is the party that makes the apartment or studio or other accommodation types available to the Customer on the basis of the accommodation agreement.
Accommodation Agreement: The Agreement concluded between the Customer and Local Residence by Hotel Keyser for the use of an apartment or studio or similar accommodation for an agreed number of nights.
Apartment: The apartment or studio or similar accommodation types to which the Accommodation Agreement relates.
Usage Fee: Price per night multiplied by the agreed number of nights. The Usage Fee can be increased with costs and the deposit.
Deposit: The part of the Usage Fee that the Customer owes to Local Residence by Hotel Keyser when making the booking.
Security Deposit: the amount that the Customer pays in advance to Local Residence by Hotel Keyser for any costs, damage or loss for which the Customer is responsible.
Times of arrival and departure: the times agreed upon between the Customer and Local Residence by Hotel Keyser.

Article 2 Conclusion of the Accommodation Agreement
The Accommodation Agreement will take effect:
- after the Customer has successfully completed and sent the booking on the website of Local Residence by Hotel Keyser or a booking website and the confirmation hereof by Local Residence by Hotel Keyser has been sent to the Customer or;
- after the Customer has received a quotation submitted by Local Residence by Hotel Keyser the customer has signed it for approval and returned it and has received the written confirmation by Local Residence by Hotel Keyser or;
- after the Customer has received a quotation at the reception of Local Residence by Hotel Keyser, has signed it for approval and has received the written confirmation from Local Residence by Hotel Keyser or;
- after the Customer has received a quotation or reservation confirmation and the Customer send us an approval of this quotation or reservation in writing such as email or mail.

The Customer will only be granted the right of access to the Apartment after the Accommodation Agreement has been concluded. If the Customer has made a booking and it has been electronically confirmed by Local Residence by Hotel Keyser, Local Residence by Hotel Keyser is unilaterally entitled to change the accommodation type or address within 48 hours after receiving the electronic confirmation without becoming liable for compensation in this connection.

 

Article 3 Payment conditions
The Customer must pay the deposit/payment into the bank account specified by Local Residence by Hotel Keyser within five days after the booking has been made. If the deposit/payment has not been paid into the bank account specified by Local Residence by Hotel Keyser within the stipulated period, the Customer may not lay claim to conclusion of the Accommodation Agreement. The full Usage Fee must be paid into the bank account specified by Local Residence by Hotel Keyser by no later than 2 weeks before commencement of the period of use. If these conditions are not met the right to conclusion of the Accommodation Agreement will lapse.

Article 4 Costs
If any costs are due in addition to the Usage Fee, this will be stated on the website of Local Residence by Hotel Keyser. The Customer will pay these costs in the same manner as the Usage Fee.

Article 5 Security deposit
Local Residence by Hotel Keyser charges the Customer a security deposit. The security deposit must be paid into the bank account specified by Local Residence by Hotel Keyser with the final payment (two weeks before arrival). The security deposit will be returned to the Customer by Local Residence by Hotel Keyser immediately after the end of the agreed length of stay, or paid back into the Customers’ bank account within one week if the deposit was paid in advance. This will be done after deducting any costs of damage caused, defects and/or loss or disproportionate consumption of energy and if the Customer is unsubscribed from any of our addresses. Any such deduction will be reasonable and at the discretion of Local Residence by Hotel Keyser.

Article 6 Obligation of Local Residence by Hotel Keyser
Local Residence by Hotel Keyser will ensure that the Apartment is made available to the Customer in a good and well maintained condition at the agreed time of arrival and in accordance with the confirmation submitted to the Customer. Local Residence by Hotel Keyser will arrange the linen and ensure it is changed in the event of a prolonged stay.

Article 7 Obligation of Customer
On arrival at the Apartment, the Customer must inspect the Apartment for any unsafe situations and/or defects.
If, in the opinion of the Customer, such unsafe situations and/or defects are present, the Customer must notify Local Residence by Hotel Keyser thereof immediately. Local Residence by Hotel Keyser will remedy these situations and/or defects as soon as possible. Overnight stays in the Apartment are permitted up to the number of persons stated on the website of Local Residence by Hotel Keyser and/or the confirmation submitted by Local Residence by Hotel Keyser. Only the persons mentioned by the Customer by name when making the booking are entitled to spend the night in the Apartment. Persons other than the Customer and any persons designated by the Customer, or friends, acquaintances or relatives may not be allowed access to the Apartment. The Customer bears responsibility for all persons mentioned. Local Residence by Hotel Keyser operates a Non-Party Policy. All forms of public or other drunkenness or disruption by the Customer will lead to the Customers’ immediate eviction. If the aforementioned provisions are violated, the Accommodation Agreement will be terminated with immediate effect and access to the Apartment will be denied. The Customer remains liable for the full Usage Fee. After the Agreement has terminated, Local Residence by Hotel Keyser will be entitled to immediately rent the Apartment to another party. The Customer is not allowed to open closed-off spaces. When leaving the Apartment, even if only for a short time, it must always be properly locked. In the event of theft or loss as a consequence of noncompliance with this provision, the Customer will be held liable for all resulting damage. Smoking and open fires are not allowed in the Apartment or anywhere in the building. If evidence of smoking is found, a fee of EUR 150 will be charged for cleaning the Apartment and the Accommodation Agreement will be terminated. Pets are not allowed. In the event of fire as a consequence of negligence, the Customer will be held liable for the resulting damage. The Customer is not allowed to place bicycles in the Apartment.

Article 8 Duration of the Accommodation Agreement
All agreements made by Local Residence by Hotel Keyser are agreements that, by its nature, are only of short duration within the meaning of article 7:232 paragraph 2 of the Dutch Civil Code. The Customer is explicitly aware that he cannot evoke the legal rent protection provisions. The agreement entered into with Local Residence by Hotel Keyser ends by operation of law on the date specified and agreed upon in the Accommodation Agreement, without a prior notice of termination being required for this purpose.

Article 9 Termination by Us 
Local Residence by hotel Keyser has the right, in case of suspicion, to terminate a booking at any time on the grounds of abuse to staff or other guests, mistreatment of the apartment or criminal activity on the part of those occupying the apartment.

Article 10 Rights of Access 
Our representatives and subcontractors have the right of access to the property at any time, with due regard to the convenience of the Customer , for the purpose of inspection of the property and to carry out any essential cleaning, repair or maintenance work.

Article 11 Cancellation policy
Please note that the prepayment is non-refundable (including instances of force majeure). The fees relating to our cancellation policy are dependent on the following notice periods given:

–         Less than 28 days prior to arrival: 50% is refunded of the total accomodation cost.

–         Less than 14 days prior to arrival: 25% is refunded of the total accommodation cost.

–         Less than 7 days prior to arrival or cancellation without prior notice:  0% refund entitlement where it has not been possible to rent the apartment to third party for any of the requested period.

Article 12 Liabilities
Local Residence by Hotel Keyser will not be liable for any delay, loss, damage or expenses incurred if a booking needs to be altered or cancelled or is unable to perform its contractual obligations as a result of events beyond the reasonable control of Local Residence by Hotel Keyser, which shall include but not be limited to events such as war, civil strife, terrorist activity, labour disputes, natural or man-made disaster, fire, flood, and adverse weather conditions. No exceptions can be made in any circumstances except if granted in writing by Local Residence by Hotel Keyser. Local Residence by Hotel Keyser will not be responsible for any loss or damage to the Customers´ goods or personal belongings kept at the accommodation.
